State of Massachusetts sued financial manager Merrill Lynch & Co. Inc. (MER) and Swiss bank UBS for foul-play in their auction-security sales. Late-July, Merril Lynch shares fell 10% as the credit and housing sectors declined. The company shares have lost nearly 50% its value since the beginning of the year. Merrill divested $4.5 billion worth of Bloomberg shares. The company lost $4.7 billion or $4.97 per diluted share for the second quarter, compared to last year quarter’s earnings of $2.1 billion or $2.24 per diluted share.


Robert Olstein, Bill Nygren, Chris Davis, Bill Miller, Brian Rogers, Ruane Cunniff, Kenneth Fisher, and Richard Snow own shares of Merrill Lynch; and Richard Pzena sold out all his MER holdings prior to March.

CONTINENTAL RESOURCES (CLR) is an independent oil and natural gas exploration and production company in the U.S. The company posted a second quarter profit of $127.3 million or $0.75 a share on strong gas and oil revenue of $303.4 million. In contrast with loss in the same quarter last year of $142.5 million or $0.87 a share, on revenue of $145.3 million.

Allegheny Technologies Incorporated (ATI) made an income of $168.9 million or $1.66 a share for the second quarter, which is 18% lower compared to $206.5 or $2 a share in the second quarter of 2007. "It's no surprise that demand is weak from the U.S. automotive and housing markets," CEO L. Patrick Hassey stated.

Shuffle Master Inc. (SHFL) manufactures casino game machines. The company revenue rose 10%, but charges offset earnings to a $0.09 decline comparable to the past two second-quarter. Shuffle Master’s profit decreased 11% to $3 million from $3.4 million. The company recently committed to a $5 million loan from Union Bank of California; SHFL currently has $65 million in loans.


As Richard Aster Jr. kept his 1,203,800 shares, Bruce Sherman sold 54% of his SHFL holdings.
