  • ParkerVision (OTCQB:PRKR) challenges recent U.S. District Court ruling in ongoing patent case against Qualcomm.
  • The ruling affects receiver patent claims, interpreting down-conversion to occur at capacitors, conflicting with ParkerVision's patent assertions.
  • ParkerVision is considering further legal action to protect its intellectual property rights.

ParkerVision, Inc. (OTCQB:PRKR), a leader in wireless radio-frequency (RF) innovation, has expressed disagreement with a recent ruling by the U.S. District Court for the Middle District of Florida. The ruling pertains to the company's longstanding patent infringement lawsuit against Qualcomm, which has been ongoing for over 11 years.

The court's decision affects only receiver patent claims, interpreting certain terms to suggest that RF down-conversion occurs at capacitors, as opposed to ParkerVision's claim that it occurs at switches, specifically the Universal Frequency Translation (UFT) Module. ParkerVision's CEO, Jeffrey Parker, argues that this interpretation conflicts with Federal Circuit guidance and their patent documentation, which clearly identifies down-conversion at a switch, not capacitors.

ParkerVision maintains that Qualcomm is aware that capacitors cannot perform the down-conversion function, contradicting both the company's extensive patent claims and the actual operation of Qualcomm's products. The company has consistently provided detailed evidence in prior negotiations with Qualcomm, highlighting the use of switches for down-conversion.

In light of the court's ruling, ParkerVision is currently exploring its legal options, including potential appellate review, to ensure the protection of its intellectual property. CEO Jeffrey Parker emphasized the importance of defending their innovations that have significantly contributed to the wireless chip market, asserting the company's commitment to upholding the integrity of the American patent system against the rising threat of foreign competition.

ParkerVision's legal strategy focuses on aligning court interpretations with established patent law and ensuring that their patented technology is correctly represented in legal proceedings. The company continues to advocate for a fair resolution that recognizes its contributions to the semiconductor industry.
